MARSHFIELD DEVELOPMENT REVIEW BOARD
Approved Minutes of December 7, 2006
Board Members present: James Arisman, Paul Brierre, Tom
Daley, Martin Johnson, and Jean Matthew (designated
alternate). Also attending: Planning Commission member
Mike Fritz, Deborah Tousignant, Bruce Hayden, Betty
O’Rourke, Kerry O’Rourke, and engineer Craig Chase.
At 7:05 pm
Bruce Hayden and Deborah Tousignant
showed the Board a sketch of a subdivision they would
like to make to their home parcel along the bank of the
Winooski River in Marshfield Village. The lot is now
approximately 5.8 acres, and they would like to divide
it into 3 pieces, with plans to have a house on each.
Bruce and Deborah acknowledge that part of the property
is in the floodplain, but do not know precisely which
part is in Marshfield’s Floodplain zoning district. This
is critical, because residential construction is not
allowed in the Floodplain district. The Board advised
them to determine to their satisfaction which part of
the property is buildable (ie. in the Village zoning
district), prepare their plan accordingly (bearing in
mind the minimum lot area required for residences in the
Village), and submit a Subdivision application to the
Town Clerk for hearing and approval by the DRB.
At 7:15 pm the Board opened public hearing on the
Subdivision
application of
Betty and Alfred
O’Rourke.
Craig Chase distributed copies of the completed survey
drawings and septic plans he has prepared for this
project. Although the configuration of the lots differs
considerably from the Sketch Plan the Applicants
presented to the Board on October 5, it still calls for
a total of 3 lots. Neither of the two smaller lots will
have frontage on the public road, and the plan is to
provide access to both via an existing right-of-way from
Route 2 that bisects the source parcel. The Board
pointed out that it would have to make any approval of
this plan conditional upon the recording of deeds which
provide for a permanent 50 foot right-of-way easement
for each of these lots. And because the plan calls for
the leach field for the Lot 3 septic system to be placed
on Lot 2, a deeded easement will be necessary for its
installation and maintenance. The Board noted that it
would have to be satisfied with the language of these
easements before it would endorse the subdivision map.
Following discussion on this point, it was mutually
agreed that this hearing would be held open to give the
Applicants a chance to have proposed deed language
prepared and submitted to the Board prior to their
deliberation on the application. Accordingly, the
hearing is tentatively set to be continued on
Thursday, February
1, 2007 at 7:00 pm.
In the mean time, the Applicants will submit language
for the proposed easements to the Board. If the Board
finds this information complete, it will close the
hearing without reopening and issue its decision on the
application.
At 7:45 pm the Board briefly discussed a new
Subdivision
application received from
Dorothy Knowles,
and a
Conditional Use/Site Plan
application for an addition to the
Village of
Marshfield’s
water treatment facility. Public hearing on Dorothy’s
subdivision proposal is scheduled for
Thursday January
18, 2007 at 7:00 pm,
and the hearing for the CU/SP application from the
Village is scheduled for
Thursday January
18, 2007 at 7:30 pm.
At 8:00 pm James moved to approve the draft minutes of
November 2, 2006, and November 30, 2006, as drafted.
Seconded by Paul, all in favor. Members Arisman, Brierre,
Daley, Johnson and Matthew then went into closed session
to deliberate on the O’Rourke subdivision.
At 8:15 pm members Arisman, Brierre, Daley, Johnson and
designated alternate Mike Fritz went into closed session
to deliberate on the Gruss/Evergreen subdivision
application.
At 10:45 pm Martin moved to adjourn the DRB meeting.
