MARSHFIELD DEVELOPMENT REVIEW BOARD

Approved Minutes of April 27, 2005

 

Board Members present: Tom Daley, Jon Groveman, Martin Johnson and Gary Wilson. Also attending: Dorene Mears and George Mears.

 

At 7:10 pm the Board opened public hearing on the Subdivision application of George and Dorene Mears. The Plan survey drawing depicted two lots of 39.5 acres and 15 acres, respectively, each containing an existing residence. Some discussion followed on whether the home on the larger lot was in the Forest and Conservation District. Although it is more than 900 feet from the public road, George believes there is documentation to support the fact that his entire lot is zoned Agricultural and Rural Residential. The Board noted that that does not appear to be reflected on the newest official zoning map, but it is not a question that needs to be resolved for purposes of subdivision approval. The board also reviewed the septic engineer’s drawings of the existing systems. Hearing was closed at 7:40 pm.

 

Tom reported that he had spoken by telephone with Ada Silverstein on April 8, and asked about their availability to attend a hearing on their Site Plan application at the DRB meeting of May 5. Ada wasn’t sure they would be back in Vermont by then, and requested that the Board hear the matter at their June meeting. The DRB will accordingly set the hearing for June 2, 2005.

 

At 7:45 pm Gary moved to approve the minutes of April 7, 2005 as drafted; seconded by Martin, all in favor.

 

The Board then discussed the status of four subdivision applications that were still pending. With respect to some of the issues presented by these proposals, Martin called the Board’s attention to some definitions in Section 180 of the Zoning Regulations that seem to be at odds with other provisions of the regulations. He felt that these inconsistencies made it very difficult for the average citizen to be able to anticipate what could be done under the regulations. Jon agreed that the examples Martin cited could be misleading, but stated that there were many such inconsistencies throughout the Regulations, and that was something the Board would always be wrestling with.

 

At 8:20 pm Martin moved to adjourn the DRB meeting. Seconded by Jon, all in favor.
